These Terms & Conditions (“Terms”) govern your use of momentsbyfreeman.com, operated by Moments by Freeman LLC (“Moments by Freeman,” “we,” “us,” or “our”).
By accessing or using this website, you agree to these Terms.
Website Purpose
This website provides information about Moments by Freeman LLC, including our walk-in photo booth experiences, packages, add-ons, availability, event services, and booking process.
Website information is provided for general informational and booking-inquiry purposes.
Booking Requests Are Not Reservations
Submitting an inquiry, booking request, availability request, contact form, email, or other communication does not reserve or guarantee an event date.
A date is not confirmed until the applicable booking requirements established by Moments by Freeman LLC have been satisfied, including any required signed agreement and booking payment or approved institutional payment arrangement.
Availability Calendar
Any availability calendar displayed on our website is provided as a convenience to prospective clients.
We make reasonable efforts to maintain accurate availability information; however, an open date on the calendar does not guarantee availability and does not constitute a reservation.
Availability must be confirmed by Moments by Freeman LLC.
Client Event Agreements Control
Event rentals may require a separate written or electronic client agreement.
The applicable client agreement, invoice, selected package, approved addendum, and other written terms accepted by Moments by Freeman LLC govern the specific event.
If these website Terms conflict with a signed or electronically accepted event agreement regarding a particular event, the applicable event agreement controls with respect to that event.
This is consistent with the integration language already contained in your contracts.
Packages, Pricing and Services
We attempt to provide accurate descriptions of our packages, pricing, add-ons, included services, and other offerings.
Pricing, package contents, availability, equipment, travel allowances, add-ons, and services may change.
The price and services applicable to a confirmed event will be established through the applicable quote, invoice, selected package, or event agreement.
Payments
Available payment methods may include Venmo, Cash App, check, purchase order, or another method approved by Moments by Freeman LLC.
Payment methods and payment schedules may vary depending on the type of client or event.
Schools, districts, businesses, organizations, and other institutional clients may be approved for purchase orders, check-processing schedules, or other payment arrangements in writing.
The applicable event agreement or approved written payment arrangement controls payment deadlines and requirements.
Cancellations, Refunds and Rescheduling
Cancellation, refund, rescheduling, and booking-payment policies vary depending on the applicable event agreement.
The cancellation and rescheduling provisions contained in the applicable client agreement control the reservation.
Submitting a cancellation or rescheduling request does not automatically entitle the client to a refund or replacement date.
Travel
Moments by Freeman LLC is based in Northwest Arkansas and provides services locally and for destination events.
We welcome inquiries for events outside Northwest Arkansas.
Travel availability, included mileage, travel fees, lodging, transportation expenses, and other travel-related requirements may vary based on the selected package, event location, and circumstances.
Applicable travel charges or requirements will be communicated before booking or otherwise established in the applicable event agreement.
Space, Power and Venue Access
Clients are responsible for providing accurate information concerning the event location and venue.
Specific requirements concerning booth space, electricity, loading access, setup, operation, breakdown, parking, security procedures, vendor requirements, and other event logistics may be established in the applicable event agreement.
Your current contracts, for example, use a 12' × 12' space and grounded outlet within 100 feet.
Outdoor Events
Outdoor service is subject to appropriate weather, surface, access, electrical, and safety conditions.
Rain, high winds, mud, sand, unstable ground, excessive heat, or other unsafe conditions may require relocation, delayed operation, suspension, or shutdown of the booth.
Specific outdoor-event requirements and remedies are governed by the applicable event agreement.
Booth Operation and Attendants
Depending on the selected package or event type, the photo booth may operate as a self-service rental or may include an on-site attendant.
The services included with a particular rental will be identified in the applicable package, quote, invoice, or event agreement.
Unless expressly stated otherwise in writing, Moments by Freeman LLC provides a photo booth experience and does not provide professional photography or videography services.
This distinction matters because your standard private rental can be unattended, while all of your current School Experiences include an attendant.
Guest Conduct and Equipment
Clients are responsible for the conduct of their guests, invitees, students, staff, venue personnel, or other event participants as provided in the applicable event agreement.
Moments by Freeman LLC may restrict booth use, pause service, or shut down service when behavior creates a safety risk or threatens equipment.
Clients and guests may not move, clean, modify, repair, or otherwise handle booth equipment except as expressly authorized by Moments by Freeman LLC.
Custom Lettering, Branding and Designs
Custom lettering, decals, artwork, school branding, event branding, and other customization may be available depending on the selected package.
Custom work may require client approval before production.
Once a design has been approved, subsequent changes may result in additional charges or may not be feasible.
Specific pricing, revision limits, deadlines, and production requirements will be governed by the applicable package or event agreement.
Digital Photo Delivery
Digital photographs may be delivered through SMS, email, online gallery, or another delivery method made available by Moments by Freeman LLC.
Immediate delivery may depend upon cellular service, Wi-Fi, internet availability, devices, and third-party systems.
A temporary inability to provide instant sharing does not necessarily constitute a failure to provide the contracted service when photographs can reasonably be delivered after the event. That language tracks the technical-delivery provision in your school agreement.
Technical Issues
Moments by Freeman LLC will use reasonable efforts to provide contracted services.
Technical problems may occasionally occur.
Remedies for substantial service interruptions within the reasonable control of Moments by Freeman LLC are governed by the applicable event agreement.
Moments by Freeman LLC is not responsible for interruptions resulting from circumstances outside its reasonable control, including venue power, internet or cellular service, guest misuse, weather, or similar conditions, subject to applicable law.
Intellectual Property
Unless otherwise stated, the Moments by Freeman name, branding, logos, graphics, original written content, website design elements, custom artwork, and other materials created by or for Moments by Freeman LLC are owned by or licensed to Moments by Freeman LLC.
Website content may not be copied, reproduced, distributed, sold, modified, or commercially used without authorization except where permitted by law.
Event Photographs and Media
Rights concerning event photographs, video, audio, and other event media are governed by the applicable event agreement and any separate written authorization.
Additional privacy protections may apply to school events and events involving students or minors.
Third-Party Services
Our website may contain or integrate third-party forms, calendars, payment services, photo-delivery systems, social-media services, or other third-party features.
Moments by Freeman LLC does not control the independent operation, availability, security, privacy practices, or terms of third-party services.

You may not use our website to:

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
Liability relating to an actual contracted event is governed by the applicable event agreement.
Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.
That also matches both of your existing contracts.
Changes to These Terms
We may update these Terms periodically as our website, services, or business practices change.
Updated Terms become effective when posted to this website unless otherwise stated.
